Submission Terms & Conditions

By submitting your story (“Submission”) to Banshee FM, you agree to the following legally binding terms:

1. License Grant

You hereby grant Banshee FM a non-exclusive, royalty-free, worldwide, perpetual, irrevocable license to use, reproduce, adapt, edit, publish, distribute, perform, and display your Submission, in whole or in part, across all media platforms, whether now known or hereafter developed, including but not limited to video, podcasts, marketing materials, live performances, and social media.

2. Editing and Adaptation

You acknowledge and agree that Banshee FM may edit, modify, adapt, or create derivative works from your Submission for clarity, length, or format. You waive any right to review, inspect, or approve the final version before its use or publication.

3. Ownership and Rights

You represent and warrant that:

• You are the sole and original creator of the Submission;
• You own all rights, title, and interest in the Submission;
• The Submission does not infringe upon or violate the intellectual property, privacy, publicity, or other rights of any third party;
• No third-party permissions are required for Banshee FM to use your Submission as described herein.

4. Waiver of Compensation

You acknowledge and agree that your Submission is provided voluntarily and without expectation of compensation. You waive any and all claims for royalties, fees, or other payments arising from Banshee FM’s use of your Submission.

5. Release and Indemnification

To the fullest extent permitted by law, you release Banshee FM, its affiliates, employees, and representatives from any and all claims, demands, liabilities, or causes of action arising out of or relating to the use of your Submission.

You further agree to indemnify, defend, and hold harmless Banshee FM from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from a breach of your representations and warranties under these Terms.

6. Publicity Consent

You consent to the use of your name, likeness, and biographical information, if voluntarily provided with your Submission, in connection with the promotion, advertising, and distribution of your Submission, without additional approval or compensation.

7. Age Requirement

By submitting, you represent that you are at least 18 years of age (or have the consent of a parent or legal guardian who agrees to these Terms on your behalf).

8. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California, USA, without regard to its conflict of laws principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Sacramento County, California.
